The undersigned, being first sworn, does hereby charge and allege, in Utah County, State of Utah, on or about January 22, 2026:

COUNT 1: DRIVING UNDER THE INFLUENCE OF ALCOHOL — SECOND OFFENSE

In violation of Utah Code Annotated § 41-6a-502, a Class A Misdemeanor, in that the defendant, Jordan Alan Mitchell, having been previously convicted of a violation of § 41-6a-502 on or about February 14, 2024, in Utah County, did operate or was in actual physical control of a motor vehicle while having a blood or breath alcohol concentration of .08 grams or greater per 100 milliliters of blood or 210 liters of breath, or while under the influence of alcohol to a degree that renders the defendant incapable of safely operating a vehicle.

COUNT 2: DRIVING WITH UNLAWFUL ALCOHOL CONCENTRATION
